General Terms and Conditions of Sale

Article 1 – SCOPE OF APPLICATION These general terms and conditions of sale apply exclusively to all sales concluded by SARL Terre de Rose through the website www.histoirederose.com/boutique. Clicking the "validate order" icon implies that the buyer has purchased the goods presented and accepted this sales contract. Placing an order implies the buyer's full and unreserved adherence to these General Terms and Conditions of Sale, to the exclusion of any other documents such as brochures, catalogs, or writings of any kind issued by SARL Terre de Rose.

Article 2 – PRODUCT INFORMATION In accordance with Article L 111-1 of the French Consumer Code, and to allow the customer to know the essential characteristics of the products they wish to purchase before ordering, SARL TERRE DE ROSE presents these details on its website. The selection and purchase of a product are the sole responsibility of the buyer. Furthermore, the customer may always contact SARL TERRE DE ROSE by email or telephone for additional information. SARL TERRE DE ROSE reserves the right to modify or change the products presented on the site without prior notice. Photographs, graphics, and illustrations of the products are non-contractual and provided for indicative purposes only, without engaging the seller's liability. Offers are valid while stocks last.

Article 3 – LIABILITY We decline all responsibility if the delivered item does not comply with the legislation of the delivery country. (Please ensure that your order contains only products authorized by the laws of your country).

Article 4 – ORDERS The customer has a withdrawal period of 7 clear days from delivery to return the products to SARL TERRE DE ROSE for exchange or refund at their own expense. In the event of exercising the right of withdrawal, the customer may choose to request either a refund of the order (excluding return costs incurred) or an exchange of products (shipping costs for the new shipment remain the customer's responsibility). Any request for exchange or refund must be made by mail within 7 days of delivery. Products must be returned to: SARL TERRE DE ROSE, 94 Bis rue de Cholet, 49700 Doué-la-Fontaine, France. Products must be in their original packaging, in new and perfect condition, accompanied by a photocopy of the purchase invoice. Returns sent "postage paid by recipient" or "cash on delivery" will be refused. Opened, damaged, or soiled products will not be refunded or exchanged. In case of abusive returns, SARL Terre de Rose reserves the right to refuse future orders.

Article 5 – PRICE Prices indicated in euros include all taxes (TTC) and are subject to change at any time without notice, within the framework of regulations in force at the time of the order. All orders are invoiced and payable in euros. For deliveries outside the European Union, the customer is exempt from VAT; the total will be indicated excluding taxes, and the invoice will be established without French VAT. Any shipping costs, customs duties, or local taxes remain the responsibility of the recipient.

Article 6 – DELIVERY TERMS AND DEADLINES Orders are shipped via La Poste (COLISSIMO). We deliver to Metropolitan France, Corsica, Monaco, Germany, Austria, Belgium, Denmark, Finland, Great Britain, Ireland, Luxembourg, Norway, Netherlands, Sweden, Switzerland, Spain, Italy, and Portugal. Contact us for other destinations. Shipping times depend on product availability (expressed in working days, excluding Saturdays, Sundays, and holidays) and start from the validation of your order. Deliveries are processed in the order orders are received. Delivery times are purely indicative; any delays do not entitle the buyer to cancel the order, refuse goods, or claim damages. Delivery costs are the buyer's responsibility, invoiced in addition to the sale price, and calculated per order based on the delivery address and weight. If paying by check, the order will only be processed upon receipt of the check.

Article 7 – PAYMENT All banking transactions are carried out via the secure online payment service P@iement CIC from the CIO bank. Under no circumstances do you communicate your bank details to us; they are encrypted using the 128-bit SSL (Secure Socket Layer) protocol and never travel in plain text over the network. The customer is in direct contact with the P@iement CIC servers.

Article 8 – GUARANTEES AND WITHDRAWAL CLAUSES In accordance with Article L. 121-16 of the Consumer Code, for all distance selling operations, the buyer has a period of seven clear days from delivery to return the product for exchange or refund, without penalty except for return costs. If this period expires on a Saturday, Sunday, or holiday, it is extended to the next business day. Any return must be in its original condition and packaging, sealed and unopened, with the original invoice, at the buyer's own expense and risk.

Article 9 – RETENTION OF TITLE Delivered goods remain the property of SARL Terre de Rose until full payment of the price. The transfer of ownership to the buyer only occurs after full payment, regardless of the delivery date. Upon delivery, the products are the customer's responsibility, who then bears all risks, losses, or insurance damages. Unless otherwise stipulated, the customer bears the costs and risks of transport. In case of damage or missing items, the customer must make all necessary reservations on the delivery note and confirm them within two days by registered letter with acknowledgment of receipt to the carrier and the company. No claim will be accepted if these formalities are not respected.

Article 10 – NO LIABILITY FOR INDIRECT DAMAGES To the full extent permitted by applicable laws, SARL Terre de Rose shall in no event be liable for any damage of any kind (including, without limitation, loss of profit, business interruption, loss of business information, or any other pecuniary loss) resulting from the use or inability to use a product, even if SARL Terre de Rose has been advised of the possibility of such damage.

Article 11 – JURISDICTION The Commercial Court of SAUMUR shall have exclusive jurisdiction in the event of any dispute or litigation relating to the formation or execution of the order.

Article 12 – BUYER'S ACCEPTANCE These general terms and conditions of sale and the prices are expressly approved and accepted by the buyer, who declares full knowledge of them and waives the right to rely on any contradictory document, particularly their own general purchasing conditions. The act of purchase implies acceptance of these terms. These conditions may be modified at any time without notice by SARL Terre de Rose, with modifications applicable to all subsequent orders.
